General terms

Kami Basics is an online wholesaler of sustainable products operating under the name “kami store”. Placing an order via the website www.kamistore.com implies the full acceptance of these terms and conditions as well as the acceptance of Kami Basics’ privacy policy.

These terms and conditions apply to all offers, quotations and sales made with respect to the products and/or services offered by Kami Basics.

The terms and conditions of sale applied to the Customer will be those in force at the time the order is placed on www.kamistore.com. Kami Basics reserves the right to modify these terms and conditions at any time.

Service

Using the website www.kamistore.com, registered customers can place orders by adding products to their basket and finalizing their order at checkout. Before confirming the order, customers need to accept these terms & conditions. Once a customer has placed an order, he/she will receive a confirmation email of his/her order. Only then will the order be deemed as placed and the sales contract concluded.

Once an order is placed, Kami Basics will collect the ordered products and prepare them for shipment or collection, depending on the shipping method chosen by the customer. Kami Basics then ships these products using the shipping partner selected. Additionally, Kami Basics provides customers with product information, pictures and technical details.

Offer and catalogue

The catalogue of products and their description on www.kamistore.com do not constitute an offer as such. The sale will only be definitively concluded upon receipt of the confirmation email from Kami Basics.

Kami Basics reserves the right to ask for additional information and to refuse the execution of the order in the absence of an adequate response or if Kami Basics considers that the information in its possession is insufficient.

The illustrations on the website are for illustrative purposes only and are not contractual.  Kami Basics is not responsible for material errors, typos or printing errors.

Product availability

The availability of products is always displayed on the website www.kamistore.com as an indication. In principle, a product indicated 'in stock' is available immediately. However, Kami Basics cannot be held responsible if the stock is no longer the same as on the date the order was placed. Any unavailability is in principle noted on the website.

If Kami Basics cannot obtain a product from its suppliers within a reasonable period, it will notify the customer of the expected delay by email. The customer may then choose to cancel or exchange the order, based on this new information. No cancellation penalty will be applied to any party for such an order cancellation.

Price information

The purchase prices mentioned on the website exclude VAT and other taxes. These prices can be modified at any moment and do not include delivery fees. The VAT, if the customer is subject to it, is charged to the customer. The prices paid by the customer are those mentioned in the confirmation email, unless there is an obvious mistake (for instance products sold below cost or at a higher price than the recommended retail price). If Kami Basics becomes aware of a mistake in the prices charged to the customer, they have to inform the customer within 7 days. In such case, the customer can cancel his/her order within 7 days of the notice from Kami Basics.

The pictures and other illustrations that present the products have no binding force and can picture products or elements not included in the indicated price.

Reservation of ownership

The goods sold or delivered remain the exclusive property of Kami Basics until full payment of the order.

The risk of loss and damage is transferred to the consumer when the consumer or the third party designated by the consumer takes physical possession of the goods.

In case of non-payment, Kami Basics can demand the restitution of goods sent. In the case that the resituated goods have been damaged, lost or stolen, the buyer shall be fully responsible for this loss.

Payment terms

Upon sending the order to the customer, Kami Basics sends an invoice to the customer in electronic format, listing all of the products sent along with payment details. The due date for the payment is always mentioned on the invoice. Payment should be done by bank transfer at the latest on the due date mentioned on the invoice.

If not stated otherwise, all invoices are due 15 days after the invoice date.

Any delay in payment will result in a surcharge, by operation of law and without prior notice of default, of 8% per annum, starting on the first day following the due date of the invoice. In addition, an administrative fee of 40 Euros will be charged to the customer for administrative costs. In addition, the amount of our invoices may also be increased by 12.50 Euros for a letter sent and 25.00 Euros for the displacement of a person.

Any dispute, to be admissible, must be notified, within a week, by registered mail, upon receipt of the invoice. In case of dispute, only the Courts of Brussels are competent

Delivery terms

Kami Basics delivers its products in Belgium and Europe. The normal delivery time is 2 to 4 working days (except any other indication on the website) in Belgium and 3 to 7 days internationally. Neither Kami Basics nor the transporter can be held responsible for the inability or delivery delay in case of unforeseen and fortuitous events, adverse weather conditions or inaccuracy of the delivery address. In case of non-respect, Kami Basics cannot be held to any compensation payment at all.

In case of delay, any damage, theft, etc. the customer can only pursue the transporter.

The customer is held responsible to verify the conditions of the packaging and the content at the time of delivery. In case of claims concerning a possible defect or any sign of deterioration (missing product, damaged packaging, broken product,…) the customer has to mention his observations accompanied by a picture, by email to customer service (info@kamistore.com) in the following two days.

Responsibility

Kami Basics cannot be held responsible for a wrong use of the products or for potential modifications of the products realized by the fabricant. The responsibility of Kami Basics will, in any case, be limited to the amount of the order and cannot be engaged for simple errors that could have existed despite the attention brought to the products' presentation. Kami Basics will never be responsible for indirect damage or for a damage that was not foreseeable at the moment of the order. Nor the pictures, illustrations nor the products' documentations engage Kami Basics. This is only indicative information. The customer engages to read carefully the product notice given by the fabricants on or in the product.

Force majeure

Kami Basics shall do its utmost to fulfil its obligations but shall not be held responsible for delays or the lack of possibility of collection resulting from cases of force majeure. The concept of force majeure implies the meeting of several criteria: it is an unforeseeable event, irresistible, independent of the will of the parties and making the performance of the obligation impossible.

In the event of delay, Kami Basics shall fulfil its obligations as soon as possible and reserves the right to distribute the remaining stocks of products among its customers in an equitable manner.

Personal data

Kami Basics respects the Belgium law from the 8th December 1992 as revised on the personal data treatment. The customer has a right to access, modify, rectify and suppress the data that concerns him or her by contacting Kami Basics.

Kami Basics may communicate its clients store names and addresses to its suppliers, in order to list them as points of sale on the suppliers' websites.

Kami Basics undertakes to comply with the provisions on the protection of privacy with regard to the processing of personal data (GDPR) when collecting and processing personal data provided by the customer.

By agreeing to these general terms and conditions, the customer has given his consent for his data to be stored and processed by Kami Basics for the purpose of administration or performance of the contract.

Kami Basics  limits the retention of personal data to the period necessary to fulfill the purposes for which it was collected, including to meet legal and accounting requirements.

Kami Basics may use photos taken during the services to promote itself on various media (Internet, press, brochures, etc.). If for any reason you do not wish your image to be used in this promotion, please inform us by email: info@kamistore.com.

The Customer has the right to object free of charge to the processing of his data for commercial prospecting or direct marketing purposes by sending an e-mail to info@kamistore.com.

The customer has a free right of access, rectification, opposition, limitation and deletion of data concerning him by sending an email to the address info@kamistore.com.

Intellectual property

The name and logo of Kami Basics as those of the enterprises indicated on the website are names and brands protected. The intellectual rights linked to the website are the exclusive intellectual property of Kami Basics or of its co-contractors. The information on the website cannot be made public, reproduced or modified without the prior written consent of Kami Basics, except for strictly personal use.

Proof

Emails and automatic registering systems of the website are used as proofs, for instance, for the order dates and order content.

Litigation rules

Present online sales terms and conditions are subject to Belgian law. Parties will seek a friendly agreement before any contentious action. The search for the friendly agreement does not interrupt the ‘brief’ delay of the legal guarantee.

Any dispute or litigation is under the exclusive jurisdiction of the Brussels courts.
